HOLD HARMLESS AGREEMENT/WAIVER
Off-Site K9 Nose Work® Workshop at the Wilderness House, Littleton, MA
It is understood that the undersigned relinquishes all claims against and agrees to hold harmless Gail McCarthy and Anne Steciw, with Scentinel Nose Work Dog Training and New England Scent Dogs (hereinafter “Instructors”), New England Forestry Foundation, and any and all other property owners on whose property training may be conducted for any loss or injury which may have been caused directly or indirectly to any person, dog, or property while participating in this Off-Site Workshop stated above, or related activities. The undersigned hereby assumes all responsibility and liability for all claims.
It is understood that every dog participating in this Off-Site Workshop will be in the care and control of the dog’s owner/handler at all times. All dogs must be confined to a crate or in a vehicle while not working with the instructor. No dog shall be tied out or left unattended in a vehicle without being carefully monitored by its owner/handler, especially when the hotter seasonal temperatures occur. It is further understood that the undersigned agrees to be fully responsible for the actions of his/her dog(s) while on the grounds on which this Off-Site Workshop is held. Consequently, if the undersigned fails to control his/her animal(s) to the satisfaction of the instructor, including uncontrolled barking, he/she will be required to remove themselves and their dog(s) from the grounds without a refund. Furthermore, any participant who demonstrates unsafe, unkind, or belligerent behavior will be asked to leave the property without refund.
All dog owners/handlers are required to provide adequate care for their animals while present at this Off-Site Workshop, while also cleaning up after their dogs and themselves. Those who do not comply may face extra financial charges or be dismissed from the premises without refund.
Finally, the novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The Instructors cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while participating in this Off-Site Workshop. Therefore, if you choose to participate in this Off-Site Workshop you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19. I have read and understood the above warning concerning COVID-19 and hereby choose to accept the risk of contracting COVID-19 for myself in order to participate in this Off-Site Workshop. In doing so, I release and waive my right to bring suit against the Instructors, New England Forestry Foundation, any and all other property owners in connection with exposure, infection, and/or spread of COVID-19 related to participating in this Off-Site Workshop.
CANCELLATION and REFUND POLICY: Please note that this Off-Site Workshop will go forward unless cancelled by the Instructors. No refunds will be made after Sunday, May 16, 2021 and refunds will be made (less any PayPal fees) only if a written cancellation request was received by the Instructor prior to Sunday, May 16, 2021. Cancellation requests made on or after Sunday, November 16, 2021 will be honored only if there is a handler available to take the spot from a Wait List.
I HAVE READ THE ABOVE RELEASE AND WAIVER AND AGREE WITH IT 100%. I UNDERSTAND THE PENALTIES FOR NON-COMPLIANCE AND AGREE TO PARTICIPATE WITHIN THE PARAMETERS STATED IN THIS WAIVER.
